No student in the Lamar School District shall, on the grounds of race, color, religion, national origin, sex, sexual orientation, gender identity, age, or disability be excluded from participation in, or denied the benefits of, or subjected to discrimination under any educational program or activity sponsored by the District.
Lamar Public Schools Student Privacy Statement
While students who suffer due to prohibited conduct have the right to file Title IX complaints, students who have been accused also deserve to have their rights protected. All parties are entitled to the right to privacy and confidentiality as permitted by law.
The Family Educational Rights and Privacy Act (FERPA) is a federal law that protects the privacy of student education records. FERPA gives parents certain rights with respect to their children’s education records. However, FERPA prevents schools from disclosing students’ records and personal information. Further, under FERPA, schools must take steps to protect privacy in these sexual misconduct investigation situations that, in some cases, reach beyond mere redaction of names and other directly-protected information to exclude facts that would otherwise identify students. Information and records that are considered part of a student’s education record are to be protected from disclosure. Therefore, in light of the privacy concerns tied to sexual misconduct investigations, the school cannot disclose certain confidential or private information from education records.
